By accessing or using the Just Perform Athletic Club website, mobile applications, or services (collectively, the "Services"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all of these terms, do not use our Services.

2. Membership and Facility Use

Membership is subject to the terms and conditions of your specific membership agreement with Just Perform Athletic Club. Members must comply with all posted facility rules and regulations. Just Perform Athletic Club reserves the right to revoke or suspend membership for violations of facility rules or these Terms of Service.

3. Description of SMS Program and Messaging Use Cases

Just Perform Athletic Club operates an SMS / text-messaging program for subscribers who have explicitly opted in via the consent checkboxes on our website form at justperformathleticclub.com/free-pass. The program covers the following messaging use cases:

• Transactional messaging: appointment confirmations, tour reminders, membership and billing notices, responses to direct inquiries, account updates, and general account communications.
• Promotional messaging: limited-time membership offers, free-trial-pass invitations, new program announcements, seasonal events, and other gym-related promotions.

Each message category requires its own affirmative, unchecked-by-default consent on the opt-in form. Marketing consent is collected separately from transactional consent, and consent to either category is never a condition of purchase, membership, or any service. Message frequency varies based on the message types you have consented to receive.

4. Opt-Out Instructions (Text STOP)

You can opt out of SMS/text messages from Just Perform Athletic Club at any time by replying STOP to any message we send. After replying STOP, you may receive one final confirmation message acknowledging your opt-out, and you will no longer receive SMS messages from us unless you opt in again through our website form. You may also contact us directly using the support contact information below to request removal from our SMS list.

6. Message and Data Rates Disclosure

Message and data rates may apply to all SMS/text messages you send to or receive from Just Perform Athletic Club. The rates that apply depend on your mobile carrier and your specific mobile service plan. Just Perform Athletic Club is not responsible for any charges your mobile carrier may impose on you for messages sent to or from our program.

7. Carrier Liability Disclaimer

Wireless carriers — including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, and other major U.S. carriers — are not liable for delayed or undelivered messages sent through the Just Perform Athletic Club SMS program. Messages may be delayed or fail to arrive due to factors outside of our and the carriers' control.

8. Age Restriction (18+)

You must be 18 years of age or older to opt in to SMS/text messaging from Just Perform Athletic Club. By providing your mobile number and checking a consent checkbox on our website form, you represent and warrant that you are at least 18 years old and the authorized user of the mobile phone number you provided.

9. No Sharing of Mobile Opt-In Data

Just Perform Athletic Club will not share, sell, rent, or otherwise provide your phone number, mobile information, or SMS opt-in consent to any third parties or affiliates for marketing or promotional purposes. SMS opt-in data is used solely by Just Perform Athletic Club for the messaging purposes described in Section 3.

Use of the Just Perform Athletic Club facility and equipment is at your own risk. You acknowledge that physical exercise carries inherent risks of injury. Just Perform Athletic Club, its owners, employees, and agents shall not be liable for any injuries, damages, or losses arising from your use of the facility, equipment, or services.

All content on this website, including text, images, logos, and design, is the property of Just Perform Athletic Club and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without prior written consent.

13. Changes to Terms

Just Perform Athletic Club reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Services after any changes constitutes acceptance of the updated terms.
